Buying land in Hesse: the state-law checks
Hesse adds state-specific rules for setbacks, Baulasten, contamination, water, forest and monuments to the ordinary purchase due-diligence file.

What differs when buying land in Hesse
A nationwide checklist is not enough when buying a plot in Hesse. The Hessische Bauordnung (HBO), the Hessian cadastre, ALTIS, water law and the state monument and mining offices distribute answers across several levels. The municipality remains responsible for the Bebauungsplan (legally binding local development plan), while the building supervision authority handles building-law questions.
Every answer must concern the same parcel. A listing may provide orientation, but it replaces neither the Baulastenverzeichnis nor a specialist authority's statement. The property due-diligence checklist helps order the documents.

Setbacks under § 6 HBO
Under § 6 Abs. 5 HBO, the usual setback depth is 0.4 H, at least 2.5 m. In commercial and industrial areas it is 0.2 H, at least 2.5 m. The reduced depth does not automatically apply against zones with another use. The confirmed Hessian source gives no separate core-area factor.
Narrow sides, boundary garages and certain subordinate building parts are treated separately under § 6 Abs. 6 and 11 HBO. Municipalities can also issue local building by-laws under § 91 HBO. A buyer of a narrow parcel should therefore check a site plan showing wall height, boundary and possible building position.
The official HBO brochure is the relevant state source. These figures are not a blanket promise for every project.
Genehmigungsfreistellung under § 64 HBO
Hesse provides Genehmigungsfreistellung, exemption from the permit procedure, under § 64 HBO. The rule includes, among other conditions, a qualified or project-related Bebauungsplan, compliance with the plan and secured infrastructure. The available Hessian sources does not establish a single maximum building class for this case.
The municipality can require a permit procedure. A period of 4 weeks is confirmed; in legally defined cases the municipality can respond within one month or 6 weeks. A buyer should therefore see the submitted documents and the municipality's response, rather than relying on the label exempt.
The Hessische Bauordnung and the local building supervision authority clarify the procedure. A project without a permit procedure must still comply with substantive law.

Baulasten under § 85 HBO
Under § 85 HBO, Hesse keeps a Baulastenverzeichnis. A Baulast (public-law building obligation) takes effect through registration and can secure access, parking, setbacks or service lines under public law. Disclosures and copies may be subject to fees.
A Grundbuch extract does not answer this question. Before notarisation, request the information for Gemarkung and Flurstück (official cadastral parcel) and relate it to the intended use. A historic extract or an answer for a neighbouring parcel helps only to a limited extent.

ALKIS and official parcel data
§§ 14-16 HVermG provide the Hessian framework for ALKIS. Official outputs are available through Ämter für Bodenmanagement and geodata services. Personal data requires a legitimate interest.
The available official sources do not establish general free access to every online output. Costs depend on product and data volume. A map extract, formal certificate and owner-related information must not be treated as interchangeable during a purchase.
The Hessian Administration for Land Management and Geoinformation explains the system. A cadastral plan also does not prove buildability by itself; planning law, infrastructure and building law are needed.

BORIS Hessen and the land-price figure
§ 196 BauGB and § 15 HVermG form the legal framework for Bodenrichtwerte. BORIS Hessen provides free online research; extracts and special products may be treated differently. A Bodenrichtwert describes a zone and a typical plot, not automatically the listed parcel.
For building-ready land in Hesse, the Hessisches Statistisches Landesamt gives an average purchase value of 246.36 EUR per m² in 2024. This is a statistical purchase value, not a Bodenrichtwert or an appraisal. Infrastructure, shape, usability and encumbrances can change the price of one parcel.

Water margins under § 23 HWG
§ 23 HWG supplements § 38 WHG. In the Außenbereich, the confirmed Hessian water margin is 10 m; inside built-up areas it is 5 m where the specialist-law conditions apply. The strip can restrict the building area, access and position of ancillary structures.
A watercourse at the boundary should therefore be checked against its exact location and the water-law designation. An aerial image does not answer every question. The Darmstadt regional authority working aid supports the request.

ALTIS and soil protection
§§ 7-8 HAltBodSchG form the basis of Hessian contaminated-site information. The register is called ALTIS, or the Hessian contaminated-site and soil-protection register. The competent office provides plot-specific disclosures; environmental information is generally accessible, but the checked basis does not confirm anonymous full access.
A missing public display is therefore not a negative certificate. Ask the authority with Gemarkung and Flurstück where there is fill, former commercial use, tanks or unusual soil. A specialist investigation may also be needed. The contaminated-site guide gives further prompts.
The official access route is the Hessian administrative portal. If the answer remains open, record it in the purchase file and price review.
Abandoned mining and ordnance
Possible abandoned mining is covered by § 69 BBergG. In Hesse, the Hessisches Landesamt für Naturschutz, Umwelt und Geologie and the responsible Regierungspräsidium are the specialist offices. Jurisdiction depends on location and type of mining. The Kassel regional authority mining information is a Hessian starting point.
Ordnance must not be reduced to a listing statement either. The Hessian ordnance-clearance service is involved through the responsible office; the checked basis does not establish a uniform cost status for every request or measure. Check the ordnance-clearance information for suspected areas.
Monument protection under § 25 HDSchG
Under § 25 HDSchG, monument status is declaratory. This applies to built and archaeological monuments: protection does not begin only when a list entry is made. The Schatzregal exists; the checked source gives no confirmed effective date.
DenkXweb is a research aid. Legally authoritative answers come from the Landesamt für Denkmalpflege Hessen and the lower monument authority. The official statutory text and DenkXweb belong in the check where a plot lies in a monument area.
Forest, agriculture and nature protection
Under § 12 Abs. 4 HWaldG, converting forest to another use generally requires permission. The official sources confirm no uniform state-wide year figure for reforestation; the exact period follows the permission and its conditions. A forest plot therefore needs information from the forestry authority.
For agricultural and forestry land, the Hessian rule gives a 0.25 ha threshold under § 2 Abs. 3 Nr. 2 GrdstVG in conjunction with the Hessian approval-exemption law. The exact transaction must still be checked. § 62 HeNatG also creates a nature-conservation pre-emption right for the Land.

Neighbour law, taxes and fees
§ 38 Hessisches Nachbarrechtsgesetz regulates boundary distances. The available official sources do not establish a general fence duty for every plot. Trees, hedges and fences must be assessed by type, location, by-law and neighbour situation. The neighbour-law and boundary-distance guide separates the concepts.
Hesse's real-estate transfer tax is 6 percent. The Hessisches Grundsteuergesetz governs property tax, while the multiplier remains a municipal matter. The Hessian tax administration explains the state implementation.
Building-law fees follow § 1 HVwKostG together with VwKostO-MWVW. The official fee schedule gives the framework; the building supervision authority calculates the individual case.

Monument law, abandoned mining, ordnance, forest law and the nature pre-emption right may also matter. Assign each open question to a specific authority. A Vorbescheid under § 76 HBO is valid for 3 years; an extension may be possible on application.
Resolve open points before the notary appointment. The parcel analysis orders the Hessian evidence for the exact parcel.
How to read an authority answer
Each office answers its own question. Geoportal Hessen and the municipality help with land-use plans, the building supervision authority with the Baulastenverzeichnis and Bauvoranfrage. This makes a positive answer easier to understand because it remains clear whether it comes from a plan, a register or an individual decision.
For a plot with several possible uses, describe intended use, building form and access in the request. A general question about buildability leaves unclear whether the issue is setbacks, water margins or a Baulast. The more precise the site plan, the more reliably the answer can later be matched to the contract.
The Geoportal Hessen collects official geodata. The legally authoritative Bebauungsplan remains with the municipality. State law is also published through Bürgerservice Hessenrecht.
Where contamination remains suspected, the contract should not silently shift the financial consequence to the buyer. The same applies to ordnance, abandoned mining and a possible nature pre-emption right. An authority answer is not a building guarantee, but it helps separate the risks.
The Hessian building-land average of 246.36 EUR per m² is only a statistical reference. It does not say whether the parcel is building-ready or whether a water margin reduces the building area. For negotiation, separate land value, infrastructure, planning law and possible remediation costs.
Tax also belongs in the financing. The 6 percent transfer tax is separate from property tax and the municipal multiplier. Fees for ALKIS, Baulasten, a Vorbescheid or specialist information may be additional.
Keep state sources separate from the municipal answer. The first part of the file contains HBO, HVermG, ALTIS, BORIS Hessen and water-law information. Then file Bebauungsplan, local by-law, Baulastenverzeichnis extract and specialist statements. This shows which rule is general and which answer is plot-specific.
Repeat the parcel number in every request. This prevents an answer for a neighbouring plot being adopted by mistake. With divisions, state whether the answer concerns the former parcel or the new one. For access, setbacks and contamination, that distinction can have major economic consequences.
If a point cannot be confirmed, record the uncertainty. For ALKIS it may concern product and data volume, for ALTIS the plot-specific disclosure, for the Schatzregal the missing effective date and for forest the actual reforestation condition. An open answer is better than an invented state-wide figure.
The notary appointment does not have to answer every specialist question. The contract should show which documents exist, what use is being bought and who carries an unresolved risk. That protects the decision from turning a research aid into a building permit.
