How an order is placed, what the report covers and where it stops.
Provider and scope of these terms
These terms apply to every report ordered through grund-check.de. Your contracting party is Kandyb Studio, owner Paweł Kandybowicz, ul. Żytnia 16/8, 01-014 Warszawa, Poland. You can reach us at support@kandyb-studio.eu.
Scope of the service
GrundCheck is an automated preflight check on a plot of land in Brandenburg. We query public data sources, match what they return to the parcel you name, and deliver the result as a digital report: a web page behind a private link and a PDF you can download.
The report covers parcel identification, the planning-law context, notes on access and utilities, notes on contaminated-site and nature-protection topics, and a list of open points in order of urgency. Where a source has nothing to say, the report says so.
Contract and how it is formed
There is no self-service card checkout on the site. You request a report by email to support@kandyb-studio.eu or start one with an access code we issued to you beforehand. We confirm the order by email before any payment is due, and the contract is formed when you accept that confirmation. A contract covers one named plot, not a subscription and not ongoing monitoring.
Price and payment
One report costs 39 EUR. That is the total payable, including any VAT that is due. There are no further charges. The payment method is set out in the order confirmation.
Delivery and how long the report stays available
Once the report is built, we send the private link to the email address you gave us. The report and the link stay available for 90 days and are then deleted automatically. Download the PDF within that period if you need it for longer.
What the report is not
The report is not legal advice and carries no legal authority. It does not replace a land register extract (Grundbuchauszug) or a planning pre-application (Bauvoranfrage), a survey, a soil or contamination assessment, tax or investment advice. It is not proof of ownership or title and not a valuation. Verify the points it raises with the responsible authorities and your own professionals before you commit.
What we need from you
We work with the details you submit. The address, coordinates, parcel identifier and municipality must point unambiguously to the plot you mean. If they do not, we ask; without that clarification the report may describe the wrong parcel.
Using the report
You may use the report for your own assessment and share it with the people advising you on that purchase, such as your notary, lawyer, architect, bank or the seller's side. Publishing it, reselling it or offering it as your own product is not permitted. Rights in the software, the analysis logic, the templates and the design stay with the provider.
Data availability
Public data sources can be incomplete, out of date or temporarily unreachable. We give no assurance of completeness and cannot guarantee that third-party services stay available. Whatever is missing is named as a gap in the report rather than estimated.
Liability
Liability is unlimited for intent and gross negligence, and for damage to life, body or health. For ordinary negligence we are liable only where a duty is breached that makes performance of the contract possible in the first place and on which you may rely; in that case liability is limited to the foreseeable damage typical for this kind of contract. We are not liable for purchase decisions, deposits, lost opportunities, design and construction costs or tax outcomes, because those must be settled with professionals before you commit. Mandatory statutory liability, including under product liability law, is unaffected.
Withdrawal and refunds
Consumers should read the refund and withdrawal policy. If no report was produced, or if the public sources fail to the point where no usable report is possible, we refund the full price.
Complaints
Email us first at support@kandyb-studio.eu and quote your report number. Consumers living in the EU can get free help from the European Consumer Centre in their own country. The provider's home authority is Poland's Office of Competition and Consumer Protection (UOKiK). We are neither obliged nor willing to take part in proceedings before a consumer arbitration body.
Governing law
These terms are governed by Polish law. As a consumer you also keep the mandatory protection of the law of your country of residence; buyers in Germany keep their mandatory German consumer rights.
Changes and contact
We update these terms when the service, the data situation or the law changes. The version that applies to your order is the one published when we confirmed it, and the date at the end of this page shows the current one. Contact: Kandyb Studio, ul.
