Buying land in Mecklenburg-Western Pomerania: coast, water
A plot in Mecklenburg-Western Pomerania needs checks for coast, protected areas, agriculture, ordnance, water, monuments and municipal planning alongside building law.

A large state with very different purchase risks
Mecklenburg-Western Pomerania is not one uniform land market. Coastal towns, islands, rural villages, large agricultural areas and former military uses create different checks. Buying a building plot near water therefore follows a different logic from buying an arable field inland.
The state-law starting point is the Mecklenburg-Western Pomerania government portal. The Landkreis, independent city and municipality decide the concrete case. Put Flurstück (official cadastral parcel), Gemarkung and current plan status into every request.
Holiday use, permanent residence and agricultural use must not be confused with secured building rights. Nature, water, monument and soil questions can limit the project independently of the price.

The new setback scale
Since the amendment of 26 May 2026, § 6 Abs. 5 LBauO M-V relies more strongly on building class. In front of the external walls of Gebäudeklassen 1 to 3, the rule is 3 m; for Gebäudeklasse 4 it is 4 m and for Gebäudeklasse 5 it is 5 m.
In commercial and industrial areas, and for antenna installations in the Außenbereich, the rule is 0.2 H, at least 3 m. Otherwise it is 0.4 H, at least 3 m. The current version names no general core-area factor and no narrow-side privilege.
For a village plot, the simple statement three metres setback is therefore insufficient. Building class, use, terrain and Bebauungsplan (legally binding local development plan) belong together. The M-V building-law overview and the pre-application guide support the assessment.
Baulast (public-law building obligation), Vorbescheid and exemption
Under § 83 LBauO M-V, a Baulast takes effect as a public-law obligation through entry in the Baulastenverzeichnis. It can secure access or another condition for building. Check the register alongside Grundbuch and cadastre.
The Vorbescheid under § 75 LBauO M-V is a separate instrument for securing an answer to a specific legal question. It must match the parcel being bought and the planned project. A statement in a sales text does not replace the complete decision with its site plan.
§ 62 LBauO M-V allows Genehmigungsfreistellung only under the statutory conditions, including an effective Bebauungsplan, secured infrastructure and no conflicting designation. The official sources give a period of one month, not a week count. Special structures and larger or particularly public-facing projects are not automatically exempt.

Cadastre, Geoportal and Bodenrichtwert
The GeoPortal Mecklenburg-Western Pomerania brings together parcels, Bodenrichtwerte, property-tax maps and land-use planning. The map is a research tool. The available official sources do not establish one answer for whether a formal cadastral extract is free: the map is open, while a formal certificate may incur a fee.
Distinguish the LAiV M-V ALKIS information and the MV service portal for cadastral extracts by product. A parcel certificate, owner certificate and map display do different jobs.
The M-V Bodenrichtwert service supplies the land-value zones. They describe a zone, not an individual building-ground risk. They say nothing about contamination, infrastructure, flooding or whether a holiday flat is permitted.
The coast is a separate layer of due diligence
Mark the water location early for a plot on the Baltic Sea, a Bodden or a larger inland waterbody. The official sources confirm a 5 m water margin in the Außenbereich under § 38 WHG. It does not confirm a separate state width for built-up areas.
The agriculture ministry water-margin information sheet belongs in the file for a waterfront plot. The federal rule is also in § 38 WHG. Address a specific measure to the water authority with a site plan.
The term near the coast does not replace a protected-area or planning check. A house, fill, bank reinforcement and new access can each raise a separate permit question. Distance from the water is not used as the sole purchase criterion.

Nature protection and the state pre-emption right
Mecklenburg-Western Pomerania protects large natural and coastal areas. Under § 66 BNatSchG together with § 34 NatSchAG M-V, a nature-conservation pre-emption right applies to parcels wholly or partly in a national park or a designated or provisionally secured nature reserve.
Carry out the nature-conservation pre-emption enquiry for the parcel before notarisation. The purchase contract may thereby receive an additional authority review. This is separate from Bodenrichtwert and buildability.
For moor, woodland, coastal meadow and extensively used grassland, document the actual use as well. Former agricultural use does not become building land merely because a road is nearby. Bebauungsplan and infrastructure remain separate checks.
Agricultural land and land transactions
Agricultural land transactions are economically and legally significant in Mecklenburg-Western Pomerania. The official sources confirm no separate state exemption under the Grundstückverkehrsgesetz. Do not price a large farm parcel on the assumption of an unconfirmed small-area exception.
Before buying, clarify use, lease, management and the exact partial area. One purchase can contain several parcels while the contract covers only part. Save the Landtag documentation on land transactions as a state-law source; the competent office decides the specific transaction.
For an Eigenjagdbezirk, the basis gives 150 ha as the independent minimum area in Mecklenburg-Western Pomerania. With a lease, the remainder retained by the Eigenjagdbesitzer can fall to 50 ha. These figures belong only to the hunting-law check, not to the valuation of an ordinary building plot.
§ 7 BJagdG is the federal reference. The state-law departure is explained in the M-V state hunting-law publication.

Soil contamination and ordnance
The digital dBAK M-V soil-protection and contaminated-site register provides an online enquiry about soil burdens. The Landesamt für Umwelt, Naturschutz und Geologie with dBAK M-V is the state-wide information office. Written requests can also go to the lower soil-protection authorities of the Landkreise and independent cities.
For former industry, military use, petrol stations, landfills or fill, obtain the information before buying. An unremarkable map extract does not prove that soil testing, excavation or disposal can be omitted.
The Munitionsbergungsdienst Mecklenburg-Western Pomerania handles ordnance. The online ordnance-burden enquiry is free; a written form application is subject to a fee. Because the routes differ, do not insert one flat amount into the purchase calculation.
Forest, monuments and mining
Forest is not merely a green backdrop in Mecklenburg-Western Pomerania. Under §§ 14, 15 LWaldG M-V, conversion of forest requires permission. The forestry authority can set a replanting period that should not exceed 3 years.
The M-V forestry-law document should be checked early where the plot includes forest or planned clearing. A Bebauungsplan alone does not answer whether forest law also applies.
Monuments are governed by DSchG M-V. The Landesamt für Kultur und Denkmalpflege M-V is the specialist authority. The official classification treats the monument list as informative; a missing public map hit is not a complete negative certificate. Put archaeology into a separate request before ground disturbance.
For abandoned mining and mining rights, the Bergamt Stralsund is the state contact. The issue is not automatically relevant to every coastal purchase, but former extraction, fill or ground movement is not settled by a general building-law answer.
Neighbour law without a state statute
Mecklenburg-Western Pomerania is among the states without its own neighbour-law statute setting fixed boundary distances for trees and hedges. The official sources point to the BGB and an information brochure from the Justice Ministry. Do not put an unconfirmed metre value into the contract or design.
The M-V Justice Ministry neighbour-law information is the right first source. Local by-laws, tree protection, Bebauungsplan and the actual stock remain relevant.
The state uses the federal model for property tax. The official sources give a real-estate transfer tax rate of 6 %. The M-V tax administration transfer-tax information and the property-tax reform information keep the two taxes separate.
Price, road contributions and building fees
For building-ready land, the official Mecklenburg-Western Pomerania purchase-value statistic gives an average of 115.30 EUR per m² in 2024. This is a state-wide average purchase value, not a Bodenrichtwert for the parcel. Compare the statistical purchase value for building-ready land with location, infrastructure and usability.
For road-building measures beginning on or after 1 January 2018, no road-construction contributions are charged under § 8a KAG M-V. This differs from federal infrastructure contributions under the BauGB. The abolition of road-construction contributions belongs in the file for a road that is not yet fully built.
Building fees follow BauGebVO M-V. The M-V building-fee ordinance gives the framework; the invoice depends on the official act and procedure. A flat figure in a listing is not an authority answer.

A purchase checklist for the state
Match the order to the landscape: parcel, municipality, plan and infrastructure first, then water, protected area, contamination, ordnance, forest, monument and mining. For agricultural plots, add land transactions, lease and hunting.
Record question, source, answer and consequence in one table. Leave open fields open, especially the inner-area water-margin width, the cost status of a general ALKIS enquiry, the agricultural-transaction threshold and the monument register. Ask the authority again with parcel and site plan.

The generated overview supports the file, but it replaces neither a decision nor written information from the competent lower authority. Before the notary appointment, compare plan status, parcel, retrieval date and open answers again.
Infrastructure is not self-evident in rural areas. Public road, private path, water, wastewater and energy must be evidenced separately. File the state-law building-order text with the LBauO M-V setback law and the LBauO M-V Vorbescheid. These are state-law texts; the municipality decides the individual case.
Coastal and island plots often bring seasonal use and special infrastructure costs. A holiday flat, permanent home and agricultural building are not interchangeable in planning law. Check the municipal by-law and current Bebauungsplan alongside state law. A positive map indication is not a permit.
Bring the documents to one status. The parcel review keeps plan, source and follow-up question together.
A written request should name not merely address and district, but parcel, Gemarkung, intended use and desired building class. The state-law permit rules, state-law permit exemption and state-law building supervision can then be assigned clearly. A precise question creates a more reliable file, especially for divisions, old buildings, waterfront paths and changing uses. Save every answer with date and parcel so it remains reviewable.
