Buying land in Hamburg: urban due diligence

Hamburg is a city-state: check the building code, Altlasthinweiskataster, ordnance information and the applicable Bebauungsplan for the exact parcel.

Hamburg is not checked like a rural municipality

Buying land in Hamburg brings dense neighbourhoods, port and commercial areas, and a small number of open landscapes together. A parcel can therefore fail on a Bebauungsplan (legally binding local development plan), a Baulast (public-law building obligation), contamination or an ordnance suspicion even when the listing calls it building land. Most competent offices belong to the Freie und Hansestadt Hamburg, not to a Landkreis.

Start with the parcel and planning law. The Hamburg Bebauungsplan portal shows whether a plan applies and which use it sets. It does not replace a Bauvoranfrage: § 10 BauGB describes the binding effect of a Bebauungsplan, while the Hamburgische Bauordnung regulates procedures and setbacks.

Start the purchase check with the documents. The property due-diligence checklist and the parcel check keep authority answers, site plan and contract draft together.

Setbacks under § 6 HBauO

§ 6 HBauO generally sets the Hamburg setback depth at 0.4 H, at least 2.5 m. The provision gives 0.2 H for commercial areas. The checked rule has no separate core-area factor; at the boundary with another type of zone, the ordinary 0.4 H rule remains decisive.

This Hamburg measure often decides the purchase of a narrow inner-city plot. The area must fit the planned building height, boundary and position of the building. The applicable Hamburg rule does not provide the so-called narrow-side privilege. A sketch showing wall heights is more reliable than the word buildable in a listing.

Inspect the Baulastenverzeichnis before buying

Hamburg keeps a Baulastenverzeichnis, the register of public-law building obligations. Under § 83 Abs. 1 Satz 3 HBauO, public-law obligations affecting a plot can be recorded there. An entry may secure access, a setback or another condition of a building project. It is not an ordinary private agreement that can be read from the Grundbuch alone.

The competent Hamburg office provides the extract through the Baulastenverzeichnis information service. Match the parcel reference to the current cadastre and the draft contract. An empty extract also does not answer whether a Dienstbarkeit, right-of-way agreement or public-law security elsewhere matters.

For a division, read the site plan together with the Baulast. A planned garage can use an existing security, but it can also be restricted by it. The Baulasten and restrictions guide separates this check from the land register.

Hamburg's Altlasthinweiskataster is public

Hamburg calls the register Altlasthinweiskataster Hamburg. Under § 5 HmbBodSchG it records indications of suspected contaminated sites and contamination. Public access is a Hamburg feature, but a map hit is still an indication, not a final statement about bearing capacity or pollutant distribution.

Before the notary appointment, compare the plot boundary in the map with the parcel. Former commercial use, fill or tanks call for further documents and possibly a soil survey. A missing entry is not the same as a chemical investigation of the building ground.

Ordnance suspicion belongs in the file

Hamburg runs its own service for Gefahrenerkundung Kampfmittelverdacht, investigation of suspected unexploded ordnance. The request is subject to a fee. The Hamburg fire service, through Gefahrenerkundung Kampfmittelverdacht (GEKV), is responsible. On inner-city plots with war damage, older industrial use or known bombing, this is a core question.

The result must match the parcel and planned intervention. A general reference to a neighbourhood does not establish whether earthworks need further investigation or clearance. Put cost and time consequences into the calculation before treating the purchase price as secure.

The ordnance check sits beside the contaminated-site register. They address different risks and must not be collapsed into one soil check. The ordnance guide supports the contract discussion.

ALKIS, Geoportal and Grundbuch answer different questions

The Geoportal Hamburg brings together maps and specialist data from the Landesbetrieb Geoinformation und Vermessung. For a formal cadastral disclosure, use the land-register and cadastral information service. The available official sources do not establish that every ALKIS product is available online without charge.

A cadastre shows parcel, location and boundaries; the Grundbuch answers ownership and encumbrance questions. Neither document alone proves planning-law buildability. Resolve a boundary discrepancy with the survey documents before the notary appointment, especially if an extension is planned close to the boundary.

Vorbescheid and Genehmigungsfreistellung

A Vorbescheid under § 75 Abs. 1 in conjunction with § 73 Abs. 2 HBauO is valid for three years. An extension is possible. For a buyer, a precise Bauvoranfrage is more useful than a general assurance: describe use, building form, height, position and infrastructure so the same question does not have to be asked again.

Hamburg also has Genehmigungsfreistellung under § 62 Abs. 1 Nr. 1 HBauO. Under its conditions it reaches Gebäudeklasse 3, with a special restriction for detached residential buildings. The period under § 62 Abs. 3 HBauO is one month, not a week count converted from it.

Exemption from the permit procedure does not make a project substantively lawful. Bebauungsplan, setbacks, Baulasten, infrastructure and protection rules remain relevant. Compare the Hamburg permit exemption service and the Hamburgische Bauordnung with the actual project.

No major transport-noise source was mapped at the plot in the Federal Environment Agency’s Round 4 (2022) EU environmental-noise screen. The result is recorded on page 98 of 182 of the sample dossier dated 12 September 2026, which is not an on-site noise assessment and says nothing conclusive about a Hamburg property.

Permit-free garden sheds and fences

The annex to § 61 Abs. 1 HBauO gives garden sheds a permit-free volume of 30 m³. For fences within the built-up area, the checked Hamburg rule gives a height of 2 m. For garages, the limit is not expressed as a cubic-metre volume; the annex uses gross floor area.

For fences in the Außenbereich, the checked answer confirms no general Hamburg height limit. Open, foundation-free fences for agricultural or forestry plots are named as a special case. A garden shed without a permit procedure can still breach a Bebauungsplan, setbacks or neighbour law.

Bodenrichtwert and Hamburg's land-price statistic

For Hamburg, official statistics give an average purchase value for building-ready land of 1026.71 euros per m² in 2024. This is a state-wide statistical purchase value, not a valuation of a particular parcel. In a city-state, location, permitted intensity and infrastructure can change the individual value sharply.

The free starting point for Bodenrichtwerte is BORIS.HH. Bodenrichtwert, purchase-value statistics and asking price answer different questions. Do not carry a high statistical square-metre price into the contract as a promise for the plot.

Purchase costs do not automatically change because the plot is in a city-state. Hamburg's real-estate transfer tax is 5.5 percent under § 1 GrEStFestG HA. Its state property-tax law follows the Wohnlagenmodell under § 4 HmbGrStG. The land-value guide keeps the figures separate.

Monument protection is declaratory

Hamburg maintains the Hamburg monument list. Under § 6 DSchG Hamburg, the Denkmalschutzamt of the Behörde für Kultur und Medien is the specialist authority. Registration is declaratory, so the absence of a visible entry is not a free pass for demolition or alteration.

Hamburg monument law has separate registration rules for built and archaeological monuments in § 4 and § 6 DSchG. § 17 DSchG concerns the Schatzregal, confirmed in Hamburg since 1 May 2013. For earthworks in a historic area, put the archaeological question beside the building application.

A monument list does not answer geology, contamination or ordnance risk. Those checks remain separate. For an ensemble, compare the current building with the Denkmalschutzamt information.

Transfer tax, building fees and road contributions

Hamburg building fees follow the Baugebührenordnung. The Hamburg fee entry points to the BauGebO. The exact amount depends on the official act and procedure; a flat listing figure is not an official fee decision.

The 5.5 percent transfer tax under § 1 GrEStFestG HA belongs in the financial plan. Hamburg also has its own property-tax statute. § 4 HmbGrStG assigns the Wohnlagenmodell, while the later tax amount still depends on property and building data and the applicable municipal factors.

For roads, Hamburg has abolished the Straßenausbaubeitrag. The available official source does not establish an exact effective date for the amending statute. The status is confirmed, not an additional date. Read the costs and taxes guide with the contract draft.

Commercial land, mining and special Hamburg areas

Hamburg is not a classic mining region. Under § 2 BergBehG HA, the Landesamt für Bergbau, Energie und Geologie in Lower Saxony is also responsible for Hamburg on mining-law questions. The official jurisdiction page does not confirm a separate Hamburg abandoned-mining disclosure. Do not confuse that with a negative soil or ordnance answer.

Federal law, state law, the municipality and each by-law have separate roles. National rules provide the wider framework. On port, industrial and former railway sites, use history, the Altlasthinweiskataster and current planning therefore matter more than an assumption about urban ground. For nature areas, Hamburg may exercise a pre-emption right under § 18a HmbBNatSchAG linked to § 66 BNatSchG. Ask about this expressly where the plot has a conservation connection.

For woodland, § 4 WaldG HA requires permission for conversion. The checked rule gives no fixed reforestation period in years; a reasonable period is set case by case. The forest-land guide belongs in the preparation for such a plot.

Hamburg's checks before notarisation

Hamburg can be checked in a short sequence tailored to the district. Record parcel, Bebauungsplan and intended use first. Then follow with setbacks under § 6 HBauO, Baulasten under § 83 HBauO, Altlasthinweiskataster, the ordnance request and the ALKIS-to-Grundbuch comparison.

For a new build with open questions, add the Vorbescheid under § 75 HBauO. For an existing building, document permits, garden shed, garage and fence separately. Check monuments, nature pre-emption and forest law in depth where location and use give a reason, and do so before the notary appointment.

Each answer should show the retrieval date and the parcel number used. A map layer replaces neither a Baulast extract nor a written building decision. Contract conditions can cover open points such as delivery of the ordnance information or a defined Vorbescheid.

The legal source must match the question: § 6 HBauO answers setbacks, § 83 HBauO Baulasten, § 5 HmbBodSchG the contaminated-site register and the DSchG the monument issue. This separation prevents a positive answer from one Hamburg register from being treated as general permission to build.

Discuss investigation, survey and possible securing costs separately in the price negotiation. That is especially relevant for fill, former commercial use and ordnance suspicion. A low price is not a substitute for a resolved hazard position.
