Request a German land register extract with the owner’s authorisation
Request a German land register extract with owner authorisation, prepare the application and check original-document rules, fees and delivery routes.
On this page
A prospective buyer should establish the access route before ordering a German land register extract. A written authorisation from the owner is one documented route. Without it, the applicant may need to demonstrate a berechtigtes Interesse, or legitimate interest; curiosity is insufficient. The framework is § 12 GBO, explained in the official Berlin procedure.
This guide helps prepare an application using owner authorisation. The relevant office decides access and supporting-document requirements. Official sources checked on 2 November 2026.
Ask the seller for documents or limited authority
Ask the seller to supply a suitable current extract or provide authorisation for you to obtain it. Request the land-register district and folio, plus the property's location. Berlin's instructions specify those register details or at least the street and house number s2.
Keep Grundbuchbezirk and Blatt in the request rather than translating both as “plot number”. A cadastral parcel number and a register folio have different functions; sending the office the exact original designation helps it identify the intended record.
Ask the intended recipient whether an ordinary or authenticated copy is required. For a bank's request, obtain its specific document requirements before ordering multiple versions. A seller's statement that a purchase is being discussed does not itself guarantee access: Berlin lists a purchase contract or draft among possible documents supporting legitimate interest s2.
Prepare an authorisation with a clear scope
Identify the owner, authorised person and property, and specify the requested inspection or copy. Include date and signature, then check the office's own requirements s2, s3. Limit the authority to obtaining the required document; do not assume a broad authority to sell the property is needed for this task.
The distinction between an authorisation to obtain information and a power to conclude a sale matters when working through an agent abroad. Ask the commissioned professional to review unfamiliar wording before the owner signs a wider instrument than intended.
Berlin requires the authorisation in the original s2. The linked Villingen-Schwenningen court instructions describe an original or authenticated copy for the stated representation route s3. A scan of a signature should therefore not be assumed acceptable everywhere.
Application text to adapt
Use the relevant office's own form where provided. The official Berlin form shows the applicant, requested copy and access-basis fields. The following German text is a preparation aid, to complete with the actual details:
An das zuständige Grundbuchamt
Ich beantrage eine einfache Abschrift des Grundbuchs für das Grundstück: Grundbuchbezirk …, Blatt …, Lage … .
Ich handle als bevollmächtigte Person des eingetragenen Eigentümers. Die Vollmacht und die nach den Hinweisen Ihres Amts erforderlichen Nachweise füge ich in der dort verlangten Form bei.
Antragstellende Person: Name …, Anschrift … . Bitte senden Sie die Abschrift und die Kostenrechnung an diese Anschrift.
Datum …, Unterschrift … .
The text requests an ordinary copy and states that you act under the registered owner's authority. Change the requested form only if needed. Leave no guessed folio number: ask the office how to identify the record if the seller cannot provide it.
For an overseas delivery address, ask the particular office whether it can use that address and what submission route it accepts. The sample is not a guarantee that every office will accept an English application or email attachment.
To compare the identified parcel with available territorial map layers, open the GrundCheck map. A report costs €29 in one language or €39 in two; read the sample report first.
Distinguish statutory output fees
The GNotKG costs schedule, inspected on 2 November 2026, lists separate items:
| Output | Schedule item | Fee |
|---|---|---|
| Print or ordinary copy | 17000 | €10 |
| Official print or authenticated copy | 17001 | €20 |
| Electronically transmitted ordinary file | 17002 | €5 |
| Electronically transmitted authenticated file | 17003 | €10 |
Source: GNotKG costs schedule; s2
These are statutory fee categories, not proof that every registry offers every transmission channel. Berlin's procedure describes its ordinary and authenticated copies at €10 and €20 s2. Verify the office's actual service before assuming that a lower electronic-file fee creates an online ordering route.
For a simple calculation, one ordinary paper copy and one authenticated paper copy total €30 under those base items. Ask whether both are necessary. A private provider's handling charge is separate from the registry fee.
Submit once through the accepted channel
Berlin describes written applications by post or fax and in-person applications; a telephone call is not the described oral application s2. Follow the actual instructions of the office handling the property.
The Villingen-Schwenningen instructions warn that duplicate applications through different channels can trigger repeated charges. They also describe the relevant state treasury's billing route. Those are local procedure details, not a universal German payment workflow.
No fixed national processing time is promised here. If a mortgage or contract review has a deadline, ask early about the current procedure and prepare complete supporting documents.
If access is delayed or refused
Ask what evidence or form is missing and respond to that specific requirement. Have the commissioned notary or adviser review an unclear authorisation rather than submitting several inconsistent versions.
If the seller supplies neither suitable documents nor a workable route to obtain them, the register review remains unresolved. Have your adviser specify what must happen before you enter a binding purchase commitment. A territorial map report does not supply an unexamined land-register record.
Once you have the correct parcel, select it on the GrundCheck map for an initial review of available territorial information. The sample report shows its scope. This is preliminary screening and does not replace legal advice or a survey.
